Get help to stay in Australia to enforce your rights
If you have been treated badly at work, you should not have to leave Australia before the problem is fixed. There are new rules to help you:
- The Workplace Justice Visa: A temporary visa that lets you stay in Australia to take legal action.
- Strengthening Reporting Protections: This allows you to apply for official protection against your visa being cancelled if you have been exploited at work.
You need “Certification”
To get the Workplace Justice Visa or the protection against cancellation, you must have your “workplace exploitation matter” (your problem at work) certified by an accredited certifying organisation.

FAQs
What this visa allows you to do:
- Stay in Australia: You can remain here while you fight for your unpaid wages or rights.
- Keep working: You have full work rights on this visa.
- Bring your family: You can include family members who are here with you.
- Cost: It is free to apply.
Is this visa for me?
You may be able to get this visa if:
- You are on a temporary visa (like a Student visa or Temporary Skill Shortage visa) with work rights;
- Your visa expired recently (less than 28 days ago); or
- You have been exploited at work.
What is “exploitation”?
To get this visa, you must have a serious problem at work (“workplace exploitation matter”). This includes:
- Underpayment: Not being paid properly, or not paid at all.
- Unsafe work: Being forced to work in dangerous conditions.
- Threats: Your boss threatened to cancel your visa or hurt you.
- Bad treatment: Bullying, sexual harassment, or discrimination.
- Forced payments: Your boss made you pay money to get the job or keep the job.
How to apply (we can help)
You cannot apply for this visa alone. You need an official group to “certify” (confirm) that you have been exploited.
